Code § 24.2-233 states that “Upon petition, a circuit court may remove from office any elected officer or officer who has been appointed to fill an elective office, residing within the jurisdiction of the court.”

Here’s how the recall effort works.

Step One: Gather Signatures

A petition detailing the reasons for removal of the elected official must be circulated, and at least 10% of the people voting in the last election for the office being recalled must sign the petition.

Step Two: Court Rules

Upon submission of the signatures, a state Circuit Court will then inform the elected official and hold a trial.

Step Three: Replace the Recalled Official

The normal procedure for holding an election to fill the vacant position will be followed.
